File relates to Michael and Kate O'Toole's receipt of a partial dependents' gratuity of £60 (sixty pounds sterling) in 1936 under the Army Pensions Acts in respect of their son IRA Commandant Seamus O'Toole. This award was reduced from the Department of Defence's original recommendation of £112.10.00 (one hundred and twelve pounds and ten shillings sterling) following intervention by the Department of Finance.
Seamus O'Toole died on 6 December 1922 at the Curragh Military Hospital during the Civil War. It is officially stated that he died from the effects of a gun shot wound received by him from National Army forces near Myshal, County Carlow the previous day. However references on file allege that when his body was returned to his family for burial it had a number of additional wounds in the back, and also showed evidence of torture. According to material on file Seamus O'Toole had served with the Irish Volunteers and IRA from 1917 onwards and during the War of Independence and Civil War.
File includes: original handwritten material submitted and signed by Michael O'Toole in support of his and his wife's application; signed handwritten report dated 28 August 1933 from Customs and Excise investigating officer, Baltinglass, County Wicklow, regarding the circumstances and means of the O'Toole family and the degree of dependency of the applicants on Seamus O'Toole at the time of the latter's death; documentation including original signed typed and copy typed correspondence (31 March 1934 - 19 October 1936) involving officials of the departments of Finance and Defence and related handwritten material, regarding the amount of gratuity to be awarded to Michael and Kate O'Toole; representations on behalf of the O'Toole's from S. Moore TD; undated unsigned handwritten note headed "Mr. + Mrs. O'Toole" showing [amounts recommended for gratuity to them from departments of Defence and Finance and M. Derrig]; signed handwritten statements regarding Seamus O'Toole's service and death from Patrick Fleming, Michael Coogan, Thomas Whelan, Joseph Byrne and James Nolan.
