Subject Information |
File relates to Bridget Phelan's receipt of a dependents' allowance under the Army Pensions Acts for herself and her three children in respect of her husband IRA Section Commander John Phelan.
John Phelan died by Military (National Army) Execution on 29 December 1922 at Kilkenny Military Barracks during the Civil War. John Phelan had been sentenced to death by Military Court for being in possession of rifle and revolver ammunition and with taking part in a robbery at Sheastown House - references state that Phelan was acting under orders and that the raid on Sheastown House was for the purpose of "collecting a levy". According to information on file Phelan had served with the IRA from 1920 onwards and during the War of Independence, Truce period and Civil War. Bridget Phelan claims that her husband had served from 1917 onwards and with 2 Tipperary Brigade and 2 Offaly Brigade also - there is nothing on file to support these claims.
See also RO159 lists "J Phelan Executed 29th Dec 1922, Kilky Bks." as a member of D Company, 5 Battalion, Kilkenny Brigade IRA on 11 July 1921 and "Whelan John Executed at Kilkenny" as a member of D Company, 5 Battalion, Kilkenny Brigade, IRA on 1 July 1922.
File includes: original handwritten material submitted and signed by Bridget Phelan in support of her applications; signed handwritten report dated 20 May 1933 from the Investigating Officer, Customs and Excise, Thomastown, County Kilkenny regarding the circumstances and means of the Phelan family and the degree of dependency of Bridget Phelan on her husband at the time of his death; original signed handwritten and typed and copy typed material relating to the refunding by the Department of Defence of educational fees relating to the children of Bridget and John Phelan; material relating to the settlement and closure of Bridget Phelan's dependents' allowance account following her death on 15 March 1966; and signed handwritten statements regarding John Phelan's service from Ted Moore and Martin Bates.
