Subject Information File relates to James Leahy's receipt of a military service pension in respect of his service with the Irish Volunteers and IRA during the service periods between 1 April 1917 and 30 September 1923 during the War of Independence, Truce period and Civil War. Applicant also claimed unsuccessfully for service in the periods between 1 April 1916 and 31 March 1917. File also relates to James Leahy's receipt of payments under the Army Pensions Acts in respect of disabilities incurred by him as a result of his service. A member of the Irish Volunteers from prior to 1916 James Leahy states that he mobilised at the time of the 1916 Easter Rising but had no active service. From 1917 to the end of the War of Independence on 11 July 1921, James Leahy served successively as a Company, Battalion and Brigade Officer Commanding with the Irish Volunteers and IRA. He was imprisoned during October and November 1917 and between December 1918 and June 1919 by the British authorities. Leahy states that he was heavily involved in organisational and training work with the Irish Volunteers as well as taking part in arms raids and the making of munitions. He claims to have organised a general IRA operation to attack [all] RIC barracks in his brigade area on a single night in January 1920 and also to have organised and lead further IRA attacks on Holycross and Borrisoleigh [RIC] barracks, attacks on British forces at Ballingarry and Ballyboy and the shooting of RIC District Inspector Wilson in Templemore during 1920 and 1921 - exact dates not on file. James Leahy continued to serve as a Brigade Officer Commanding during the Truce period and Civil War and states that he was in charge of IRA forces occupying Templemore Barracks when it was attacked by National Army forces. James Leahy evaded arrest/capture during the Civil War and states that he remained on the run until 1924. Material relating to subject's service pension application include: typed transcripts of sworn statements made before the Advisory Committee, Military Service Pensions Act, 1934 by James Leahy (2 pages) on 8 May 1935, James Stapleton (1 page) on 24 May 1935, Patrick McDonnell (1 page) on 25 May 1935, Dan Breen (1 page) on 20 May 1935 - this statement also refers to Breen's own activities in the Mid Tipperary Brigade/2 Tipperary Brigade area dealing with police work just prior to the end of the War of Independence - Sean Fitzpatrick (1 page) on 5 June 1936 and E. O'Reilly (2 pages) on 15 June 1936; standard forms Referee R.15 dated 29 October 1935 and 21-23 April 1936 showing details of subject's rank and unit strength as of 11 July 1921 and 1 July 1922 from records supplied by Sean Fitzpatrick and the 2 Tipperary Brigade IRA committee; material (4 September 1936 - 6 April 1937) including original signed typed and handwritten, and copy typed correspondence and documentation involving the departments of Defence and Local Government and Public Health, Tipperary North Riding County Board of Health, James Leahy, [Senator] William Quirke, as well as internal Department of Defence handwritten memoranda/correspondence relating to James Leahy's employment with the Tipperary North Riding Board of Health, his level of payment, amounts received for expenses incurred in the course of his work with that body, whether amounts received for expenses were additional to or included in his rate of salary, and the degree to which his pension should be abated as a result; material (2 October 1942 - 21 May 1943) including original signed typed and handwritten and copy typed correspondence involving the Department of Defence, the Turf Development Board, James Leahy, relating to Leahy's employment with the Turf Development Board, whether or not he can be considered to be in receipt of payments out of public moneys while in their employment, whether and to what degree his service pension should be abated as a result; and material relating to James Leahy's widow and surviving children - partly closed.
