File relates to Daniel Harty's application for a service pension under the Military Service Pensions Act, 1934 and appeal. Applicant claims for service between 1 April 1917 and 31 March 1923.
States he joined the Irish Volunteers in 1917 and was involved in routine activities. States he took part in the Garryspillane (Cross-of-Tree ambush) (1920), and the transfer of despatches.
In 1921, he participated in the Lackelly ambush. Following this, his home was raided and he was on the run for a few weeks. No engagement during the Civil War. Until then he states he was doing intelligence work for Sean Forde.
Initial decision of the Referee asserts that Harty was not a person to whom the Military Service Pensions Act, 1934 applied. Applicant appeals the decision in a letter dated 14 March 1940 and provided additional details as well as provided evidence on appeal. However, the decision remained unchanged.
File contains: application form for service pension filled in (May 1935); certified reference letters; typed summary of sworn evidence given (on appeal) before interviewing officers by applicant (25 February 1941); copy order delivered in the High Court on 15 September 1943, quashing the findings of the Referee; typed additional evidence (of applicant and others) dated 8 May 1945; petition submitted by applicant to the Board of Assessors and to the Referee (dated 11 August 1951; material regarding the appeal; application for a service medal (medal issued on 12 January 1948).
Applicant also applies for a wound pension (3 February 1925) in respect of injuries sustained near Lackelly on 3 May 1921 (two scalp wounds, one in jaw, 6 teeth broken and one finger fractured). His claim is unsuccessful.
