Subject Information |
File relates to Edmond Denihan's unsuccessful application for a service pension under the Military Service Pensions Act, 1934. Applicant claims for service between 1 April 1916 to 30 September 1923 with the Irish Volunteers and the Irish Republican Army.
States he joined the Irish Volunteers in 1916 and states he was mobilised for Easter Week and stood to order. He was involved in routine activities until the Truce (drilling, training, carrying dispatches). States he was involved in the Glenacurrane ambush (December 1920). He was a member of the Knockadea until May 1921 and joined the Knocklong Company. Took part in the Shraherla ambush. During the Civil War applicant was on outpost duty for the destruction of Knocklong bridge and for the attack on the Free State troops at Knocklong Post Office in October 1922.
Initial decision of the Referee asserts that Denihan was not a person to whom the Military Service Pensions Act, 1934 applied. Applicant appeals the decision in a letter dated 14 March 1940.
Applicant gave oral evidence on appeal on 8 May 1945 but no change was recommended.
File contains: application form for service pension filled in and dated 28 December 1935; summary of sworn evidence given beofre the Verifying Officers by Edmond Denihan on 25 February 1941; certified typed reference letters (original letters are contained in 34SP13588); copy order delivered in the High Court on 29 September 1943, quashing the Referee's original findings on the grounds that the claimant's application was rejected without the Referee hearing the evidence; typed evidence given by applicant following the appeal, along with the evidence given by Maurice Lee, Ed.Tobin, Sean Lynch, Daviv Clancy, D.Grace, T.J.Keane, Mr Riordan.
File 34SP40800 contains material relating to the claimant's appeal; letters of reference; copy of affidavit of claimant dated 29 December 1945, sworn at Hospital, County Limerick.
