File deals with the case of John Guiney, a military service pensioner under the Act, 1924, who was charged and convicted, along with 8 other named persons, before the Special Criminal Court on 5 March 1940 for offences arising out of picketing and destruction of fresh milk during the Dublin Milk Strike of that year. As a result of his conviction on “scheduled offences”-(unlawful assembly, malicious damage and conspiracy etc) his military service pension became forfeit. The Special Criminal Court-through Registrar Commandant R.J. Feely initiated the matter of restoration of his pension, using a wrong procedure. Guiney also appealed the loss of his pension. The Departments of Justice and Defence engaged in correspondence leading to a Submission to the Government (16 May 1940) 3pp recommending the restoration of Guiney’s pension, which was approved and restored with effect from 28 May 1940.
