File relates to James Cooney's receipt of a military service pension in respect of his service with the Irish Volunteers for part of the periods between 1 April 1916 and 31 March 1917 and with the National Forces for part of the periods between 12 July 1921 and 30 September 1923.
James Cooney was imprisoned in Mountjoy from February to July 1916 for obtaining a rifle from a British soldier. He joined the National Army in April 1922 and served with the Defence Forces until April 1924. His application under the 1924 act was rejected in March 1926 as his claim to service for the period of his imprisonment in 1916 was not accepted as service of a nature or duration to warrant the award of a Certificate of Service. Similarly his application under the 1934 act was rejected in October 1940 on the grounds that he was not a person to whom the act applied. Cooney appealed this decision to the Minister for Defence in 1944 and was finally awarded service for pension purposes in February 1945 by the Board of Assessors, Military Service Pensions Act, 1924 constituted under the Military Service Pensions Act, 1934.
