Subject Information File relates to Jeremiah O’Sullivan’s unsuccessful application for a military service pensions. O’Sullivan claimed for the service periods between 1 April 1916 and 11 July 1921 during the pre-Truce period only. During the week of 1916 O’Sullivan claimed he was a member of H Company, 1 Battalion, 1 Kerry Brigade of the Irish Volunteers under Austin Stack and was available and awaiting orders. In the lead up to and during the War of Independence (January 1919 – July 1921) O’Sullivan states he was a member of D Company (Churchill), 9 Battalion, 1 Kerry Brigade and was engaged in capturing rifles and ammunition from ships, capture of soldier from a train at Kilfenora (Kerry), capture of Fenit Royal Irish Constabulary (RIC) Barracks and scouting and guarding work. O’Sullivan did not claim for active service during the Truce Period and Civil War (June 1922 – May 1923). According to documentation on file O’Sullivan was allegedly court martialled and dismissed from the IRA and his role as First Lieutenant in November 1920 for “refusing to take part in two operations” relating to the Spa Ambush. O’Sullivan’s file contains extensive material related to establishing if he was in fact court martialled and dismissed or if his military service continued to the end of the War of Independence. There are a number of contradictory testimonies on file from Officers/Captains and other Volunteers from O’Sullivan’s company and brigade including Patrick Paul Fitzgerald MSP34REF4061, Michael Moriarty, James Carmody, James Walsh and John Brosnan MSP34REF5648. The question of whether his service continued is key to the awarding (and subsequent cancellation) of a Military Service (1917-1921) Medal which entitled him to a Special Allowance. Following a number of appeals and considerable debate the decision to hold the medal not duly awarded was upheld in 1970. O'Sullivan appealed and re-applied for a Special Allowance which was awarded 1975. DP28547 file relates to Jeremiah O’Sullivan’s application for a Special Allowance. O’Sullivan was initially awarded a Special Allowance of £95:10:00 per annum in 1957. This allowance was cancelled in 1958 after O'Sullivan’s Military Service Medal was found not duly awarded. O’Sullivan made another application in October 1975 and was awarded £263.50 per annum, he was also awarded a sum of £491.58 for arrears for the years 1973-1975.
